The use of information collected through our Services shall be limited to the purpose of providing the specific Service for which the Customers have engaged Adaptive Insights.
The Adaptive Insights privacy practices, described in this Policy, comply with the APEC Cross Border Privacy Rules System. The APEC CBPR system provides a framework for organizations to ensure protection of personal information transferred among participating APEC economies. More information about the APEC framework can be found here. The APEC certification does not apply to instances where we process data on behalf of clients for their benefit, such as when we act as a data processor.
EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield
Adaptive Insights and its UK subsidiary company, Adaptive Insights Limited, participate in and have certified their compliance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework. Adaptive Insights is committed to subjecting all personal data received from European Union (EU) member countries and Switzerland, respectively, in reliance on each Privacy Shield Framework, to the Framework’s applicable Principles. Adaptive Insights is responsible for the processing of personal data it receives, under each Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. Adaptive Insights complies with the Privacy Shield Principles for all onward transfers of personal data from the EU and Switzerland, including the onward transfer liability provisions.
With respect to personal data received or transferred pursuant to the Privacy Shield Frameworks, Adaptive Insights is subject to the regulatory enforcement powers of the U.S. Federal Trade Commission. In certain situations, Adaptive Insights may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

Under certain conditions, more fully described on the Privacy Shield website, you may invoke binding arbitration when other dispute resolution procedures have been exhausted.
Information Collection and Use on the Site
We collect contact information, such as your name, title, company name, address, phone number, and e-mail address and certain company information, such as annual revenues, number of employees, or industry, from visitors who wish to receive information about Adaptive and its products and services. We use this information to provide you with information about the products and services that we provide and to send information regarding Adaptive or its partners, such as newsletters, promotions and events.
Information Collection and Use through the Services
We require Customers who register to use the Services offered on our Site to give us contact information, such as their name, company name, address, phone number, and e-mail address, and financial qualification and billing information, such as billing name and address, and the number of users within the organization that will be using the Service, and we may also ask for additional information such as title, department name, fax number, and additional company information, such as annual revenues, number of employees, or industry. It is the Customer’s obligation, as the data controller, to inform its registered users about the purposes for which information about them is collected and may be used on the Services. Registered users can update or remove their account information at any time by logging into the Site and editing their account information.
Adaptive uses the account information that we collect to set up the Services for individuals and their organizations. We may also use the account information to contact our registered users to further discuss customer interest in Adaptive and its products and services and the Services that we provide, and to send information regarding Adaptive or its partners, such as newsletters, promotions and events. All financial and billing information that we collect through the Site is used solely to check the qualifications of prospective customers and to bill for the Services. Except as we explicitly state at the time we request information, we do not disclose to third parties the information provided.
Registered users are required to provide an email address when registering for the Service, in order to receive a username and password. We may also email information regarding updates to the Services or Adaptive, and will send a Customer Newsletter. Registered users of the Services will be using the Site to host data and information ("Data"). Adaptive will not review, share, distribute, print, or reference any such Data except as provided in your Subscription Agreement, or as may be required by law. Individual records may at times be viewed or accessed for the purpose of resolving a problem, support issue, improving system performance, or suspected violation of your Subscription Agreement, or as may be required by law. Users are responsible for maintaining the confidentiality and security of their user registration and password.
Adaptive collects and processes third party personal information under the direction of our Customers. We have no ownership of this information or any direct relationship with individuals whose personal information may be processed as part of providing our Services.

An individual who seeks access to their data, seeks to correct, amend or delete inaccurate data, or wishes to opt-out of communications from a Adaptive Customer should direct his/her query to the Adaptive Customer he/she interacts with directly (the data controller). If an Adaptive Customer requests that we remove information on their behalf, we will respond to their request within 30 days.
Adaptive may transfer personal information to other companies that help us provide our service. Transfers to subsequent third parties are covered by the provisions in this Policy regarding notice and choice and the service agreements with our Customers.
Adaptive will retain personal information we process on behalf of our customers for as long as needed to provide services and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
Our Site offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at email@example.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
We display personal testimonials of satisfied customers on our site in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at firstname.lastname@example.org.
As is true of most websites, we gather certain information automatically. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system, date/time stamp, and/or clickstream data to analyze trends in the aggregate and administer the site.
Technologies such as cookies, beacons, tags and scripts are used by Adaptive and our marketing partners, affiliates, or analytics service providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual as well as aggregated basis.
We, and the third parties with whom we partner to provide certain features on our website or to display advertising based upon your web browsing activity, use Local Storage (LS), such as HTML5 to collect and store information. Various browsers may offer their own management tools for removing LS.
Third Party Tracking
Adaptive Insights and our third party advertising partners use clear gifs (web beacons), images and scripts. We tie the information gathered to our customers’ personal information.

We use clear gifs in our HTML-based emails to let us know which emails have been opened by recipients. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns. If you would like to opt-out of these emails, please see “Choice and Opt-out.”
Information Sharing and Disclosure
Adaptive will not rent, sell, or share personal information about you with other people or nonaffiliated companies except, to provide the Services that you have requested, when we otherwise have your permission, or under the following circumstances:
- To provide the information to our trusted partners who work on behalf of or with Adaptive under confidentiality agreements. These companies may use your personal information to help Adaptive communicate with you about offers from Adaptive and our marketing partners. These companies do not have any independent right to share this information.
- To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims;
- When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.
- In connection with a merger, acquisition, sale of assets of Adaptive or in the event of bankruptcy. If Adaptive or our assets are acquired by another company, that company will assume the rights and obligations as described in this Policy. You will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.
We will only share your personal information with third parties in the ways that are described in this Policy.
Access to Your Account Information and Updating Information
You have the right and ability to edit your account information, at any time. Registered users can update or remove their account information at any time by logging into the Site and editing their account information, by emailing our Customer Support at email@example.com or postal mail at the contact information listed below. We will respond to your request to access within 30 days.
You can also opt in or out of receiving future communications of special offers and new product information by sending us an email at firstname.lastname@example.org, or you can unsubscribe by following instructions contained in the messages you receive. We do reserve the right to send you certain communications relating to the Service, such as service announcements and administrative messages, that are considered part of your account membership, and we do not offer you the opportunity to opt-out of receiving those messages.
We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services contact us at email@example.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
The security of your personal information is important to us. When you enter sensitive information (such as login credentials), we encrypt the transmission of that information using secure socket layer technology (SSL).
We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security.
